GianCann Inserito 25 Novembre 2017 segnalazione Share Inserito 25 Novembre 2017 Più di un socio, in questi giorni, mi ha chiesto spiegazioni sul "fenomeno" del cambio di nome di gruppi e/o pagine Facebook che, ultimamente, stanno sostituendo la parola LEGO con Brick. Su Facebook ho letto varie versioni ma, nella realtà, nessuna è quella esatta. Partiamo da un fatto: LEGO(r) è un brand... un marchio registrato... e, da sempre, ci sono delle policies sul corretto uso di questa parola: The LEGO Trademarks may be used under certain Limited Circumstances on an Unofficial Web Site The LEGO trademarks (but not the logo) may be used in a non-commercial manner to refer to LEGO products or elements which are shown or discussed on a web site, as long as the trademark is not unduly emphasized or used in a way that can lead an observer to mistakenly believe that the site is sponsored or authorized by the LEGO Group.Proper Use of the LEGO Trademark on a Web Site If the LEGO trademark is used at all, it should always be used as an adjective, not as a noun. For example, say "MODELS BUILT OF LEGO BRICKS". Never say "MODELS BUILT OF LEGOs".Also, the trademark should appear in the same typeface as the surrounding text and should not be isolated or set apart from the surrounding text. In other words, the trademarks should not be emphasized or highlighted. Finally, the LEGO trademark should always appear with a ® symbol each time it is used.The LEGO Trademark cannot be used in an Internet Address The LEGO trademark should not be incorporated into an Internet address. Internet addresses have become useful tools for people to identify the source of a homepage. Using "LEGO" in the domain name would be creating the misleading impression that the LEGO Group sponsored the homepage. Fonte: https://www.lego.com/en-us/legal/legal-notice/fair-play Inoltre, a giugno del 2016 (oramai un anno e mezzo fa) TLG ha diramato un documento agli RLUG, in cui specifica alcune restrizioni sull'utilizzo delle loro IP (intellectual property). Il documento (che qui trovate allegato), ha dato un anno e mezzo di tempo ai LUG riconosciuti per adeguarsi. Alcuni LUG non hanno avuto bisogno di far nulla (come ItLUG), altri invece dovranno (se già non l'hanno fatto) modificare il proprio logo perché magari include parti di minifig (vedi, ad esempio, BrianzaLUG o CLV) Guidelines for use of LEGO IP (pdf) Pertanto, niente di nuovo... cose che già si sapevano da un anno e mezzo. Semplicemente, si avvicina il 31 dicembre 2017. Potrebbe essere anche più vecchia della nostra LEGO tra i due Marchi non c'è assolutamente alcuna sovrapposizione appartenendo a due categorie merceologiche nettamente diverse. Inoltre in Italia il preuso ti permette di utilizzare un marchio anche in caso di sovrapposizioni con Marchi identici. Non servono mica gli avvocati per tutelare i diritti così di base.
